TERMS OF APPLICATION/EMPLOYMENT
1. I understand that the employment selection process at Southwest includes the successful completion of all interviews and evaluation of my application and all information I provide.
2. I understand that if I proceed in the employment selection process, Southwest will conduct a review of my prior employment, education, residences, motor vehicle records (for driving positions), and criminal history, and will require me to pass a preemployment drug screen for the following drugs: marijuana, cocaine, opiates, amphetamines, and phencyclidine (PCP)(other drugs). I also understand that under federal TSA regulations, I may be subject to the collection of fingerprints and submission and/or re-submission to the Federal Bureau of Investigation (FBI) for a required criminal history record check.
3. In consideration of Southwest’s review and evaluation of my application for employment, I agree to bring any lawsuit or other legal action arising out of my employment with, or my application for employment with, Southwest within one year after the date of the employment action that is the subject of the lawsuit or other legal action. While I understand that the statute of limitations for claims arising out of an employment action may be longer than one year, I AGREE TO BE BOUND BY THE ONE YEAR PERIOD OF LIMITATIONS AND I WAIVE ANY STATUTE OF LIMITATIONS TO THE CONTRARY.
4. In consideration of Southwest’s review and evaluation of my application for employment, I AGREE NOT TO BE A MEMBER OF A CLASS-ACTION, COLLECTIVEACTION OR REPRESENTATIVE ACTION LAWSUIT AGAINST SOUTHWEST. I further agree to bring any lawsuit or other legal action arising out of my employment with, or my application for employment with, Southwest on an individual basis, and not to bring claims on a class, collective, or representative basis.
5. I hereby authorize, to the extent allowed by applicable federal, state and local laws, Southwest to conduct its own investigation of my references, employment history and education and, further, authorize the references and prior employers I have listed to disclose to the Company information related to my employment history and qualifications for the position for which I am applying, without giving me prior notice of such disclosure.
6. I understand that at all times, the manufacture, use, sale, possession, distribution, or transfer of any illegal drugs, controlled substances, or unauthorized use of alcohol on Southwest premises is strictly prohibited and that failure to comply will result in termination. I agree to submit to a medical examination(s) by a doctor(s) designated by the Company in accordance with Company policy, during the course of employment when the Company so requests unless otherwise prohibited by law. I agree to abide by all present and future applicable policies and procedures of Southwest and applicable federal and airport regulations with respect to both work performance and standards of personal conduct. I understand that smoking is not allowed at Southwest work locations where prohibited by ordinance or company policy. If employed, I understand that my employment is for an indefinite period of time; that I have not been promised continued employment by Southwest for any definite, specified period of time; and that my employment with Southwest may be terminated at any time for any reason, except as otherwise required by law or an applicable collective bargaining agreement. I understand that completion of this employment application form does not constitute any type of employment agreement or contract. I understand that I am required to comply fully with all personal identification and employment eligibility requirements of the Immigration Reform and Control Act and that failure to do so will result in termination.
7. During any employment at Southwest all right, title and interest, including without limitation, all copyrights and patents, in and to any material produced or inventions developed by me which affect or relate to Southwest’s business or affect or relate to the airline industry shall vest in Southwest Airlines and I shall have no personal right, title, or interest whatsoever therein.
8. Applicants may be ineligible for positions that create a direct reporting relationship or power-differentiated relationship with a Southwest Airlines Employee with whom they live or have a close personal relationship. Additionally, Applicants may be ineligible for positions that grant access to confidential Company information if they are married to or living with an Officer, Director, Manager of Southwest Airlines, or with any other Employee at Southwest who has access to confidential company information of a competing airline.
I understand and acknowledge by my signature below that misrepresentation or omission of facts by me on this application or during the hiring process is cause for immediate dismissal. I certify that all of the information I have provided to Southwest is true, correct, and complete.
